Over the years, AI has evolved and found applications in diverse areas such as healthcare, agriculture, education, governance, and financial services.
AI systems, such as Siri, Google Maps, and autonomous vehicles, have become an integral part of our daily lives. These systems use machine learning algorithms to analyze data, identify patterns, and make informed decisions. The demand for AI technology is rapidly increasing, driving the need for robust intellectual property protection.
Intellectual property rights play a crucial role in protecting innovation and incentivizing creators to continue their research and development efforts. In the context of AI, protecting intellectual property is essential to encourage further advancements and ensure fair competition in the market.
Three key areas of intellectual property law – patents, copyrights, and trademarks – warrant special attention in the context of AI. In this article, we will primarily focus on patent law and how it intersects with artificial intelligence.
A patent is a legal right granted by a government to an inventor, providing exclusive rights to their invention for a limited period. It prevents others from making, using, selling, or importing the patented invention without the inventor's permission.
In the realm of AI, the question arises as to who can be considered the inventor and owner of an AI-generated invention. Traditionally, patents have been granted to human inventors. However, with AI systems capable of generating novel and inventive solutions, the issue of AI-generated inventions is becoming increasingly complex.
In many countries, including India, patent laws define an inventor as a natural person. This definition poses challenges when it comes to patenting AI-generated inventions. Since AI systems are not considered legal persons, they are currently ineligible for patent protection. Only a human inventor or an organization represented by humans can file a patent application.
The rapid advancement of AI technology necessitates legal reforms to address the challenges posed by AI-generated inventions. While some countries, like the USA and the UK, have made efforts to interpret existing patent laws to accommodate AI inventions, there is still a lack of clarity and consensus on this issue.

The question arises as to whether AI systems can be considered authors of creative works they generate. In many jurisdictions, including India, copyright laws define an author as a natural person. Therefore, AI systems are not eligible for copyright protection as authors.
However, the issue becomes more complex when AI systems are used in the creative process, assisting human authors in generating works. In such cases, the copyright ownership may lie with the human author, while the AI system may be considered a tool or medium of expression.
As AI continues to advance, it is essential to address the intellectual property issues it raises. Here are some key considerations:
Legal Reforms: Governments and policymakers should consider introducing legal reforms to address the challenges and complexities of AI-generated inventions. This may involve recognizing AI as a contributor to innovation and extending intellectual property rights to AI systems.
International Cooperation: Given the global nature of AI research and development, international cooperation is crucial. Countries should collaborate to establish common standards and frameworks for protecting intellectual property in the AI era.
Ethical Guidelines: Alongside legal reforms, ethical guidelines should be developed to ensure responsible AI development and usage. These guidelines should address concerns such as bias, transparency, and accountability in AI systems.
Licensing and Agreements: Clear licensing and contractual agreements should be established between AI developers and users to determine the ownership and usage rights of AI-generated works.
As AI becomes increasingly integrated into our lives, it is essential to navigate the complexities of intellectual property protection. Patent law and copyright law need to evolve to accommodate AI-generated inventions and works. Legal reforms, international cooperation, and ethical guidelines are necessary to ensure a fair and robust intellectual property framework in the AI era.
